Digital Millennium Copyright Act Policy
The DMCA Policy is in place to protect the copyright of our materials and that of other internet users. We respect other people’s intellectual property, just as we expect ours to be respected. The DMCA Policy is a platform for engagement, with any person or entity that might feel like our pages have infringed on the copyrights. According to the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), any copyright owner can get in touch with us through our DMCA Agent, if at any time feel like the content on our pages violates the copyrights.
Pursuant to the “safe harbor” provisions of the DMCA we may claim immunity to some of the said infringement. Your infringement claim should be in good faith, and should stipulate the following;
- Proper outline of the copyrighted work on the infringement claim
- Physical or digital signature of the copyright owner
- Provide the location of the said infringed work. You could provide a URL to the page
- A statement in good faith indicating that you are confident that the information on the said page is infringing on your copyrights.
- A statement in good faith that all that is stipulated in the notification is accurate, and that the complaint is authorized by the copyright owner to lodge the complaint.
Title 17 USC §512(f) of the DMCA provides that a complainant might face possible penalties for misrepresentation of information on the notification of infringement under the 17 USC §512(c)(3) clause. All the identities and information provided on the notification of infringement shall be shared with the alleged infringer. By sending the notification, you consent to all its content being shared with the alleged infringer.
If you come to receive a notification of some of your material being taken down as a result of copyright infringement claim, you could send a counter notification with a restoration request, seeking to have the material restored. The request shall be sent to our DMCA agent and should contain the following information pursuant to the 17 USC Section 512(g)(3) clause.
- It shall have your physical or digital signature
- A description of the material as it was before being taken down
- A statement in good faith that the material taken down was done so wrong, or as a result of misidentification.
- Your contact and location details and a statement that you will accept the process of service from the party that sent the initial infringement request.
We take copyright infringements very seriously, and we keep records of infringement notices so that we can identify repeat infringers. Such accounts shall be closed. We reserve the right to change any part of the DMCA policy above as we deem fit. Your continued use of our services constitutes consent to the policy as it is. All accounts on the platform are subject to the policy as is currently constituted. You are expected to read and understand it at all times. If at any time you do not consent to the policy, you are required to request for a termination of your account.
